International, European and National Data Protection Law

Inhalt:

With the establishment of the "Internet of Things and Services", many areas of life are determined by data processing. The ubiquitous and constantly evolving level of digitalization in everyday life also favors the emergence of Big Data and the use of data mining. Against this background, data protection law has recently been established on various legal levels. The aim of the lecture is to comprehensively address data protection law in international, European and German law and to show the relationship between its international establishment and European and German developments. In addition to the history of data protection, the foundations, sources of law and basic principles in the multi-level system, special attention will be paid to the right to protection of personal data in the context of fundamental and human rights, also against the background of relevant case law. The question of the need for better data protection by State actors is addressed. Last but not least, data protection law is presented from the perspective of its cross-border significance in specific areas such as medical research, the use of online services and social media, and the fight against terrorism. The consideration of information-theoretical and -ontological basics as well as technological developments such as cloud computing complement the course with interdisciplinary traits.

Inhalt:

orbesprechung am 28. April 20 This four-day colloquium offers an in-depth, interdisciplinary look at the challenges and opportunities arising from the use of artificial intelligence (AI) in the processing of medical data. At a time when AI technologies are increasingly being integrated into medical processes, it is crucial to understand both the technical foundations and the ethical and legal implications. The course is open to students from all faculties. Previous technical or data protection knowledge is helpful, but not a prerequisite.

Learning objectives: Awareness of current data protection challenges, working and functional principles of AI models, ethical awareness when using AI models.

Inhalt:

This colloquium offers an in-depth examination of the landmark decisions of the European Court of Justice (ECJ) and the European Court of Human Rights (ECHR) of the past twelve months, with a particular focus on data protection and privacy as well as the impact of digitalisation on fundamental and human rights in the context of health. The course is designed as a key qualification and imparts both substantive knowledge and methodological skills in the field of European law.

The colloquium follows a didactic approach that encourages the active participation of all participants:

1. Moot court format: Students work in teams of two and take turns assuming different perspectives for selected case law.

2. Contextualisation: The decisions dealt with are not considered in isolation, but embedded in the wider context of European legal developments, political implications and social effects.

3. Joint analysis: Following the moot court sequences, the course offers space for a critical overall reflection in which the lines of argumentation are examined, alternative solutions are discussed and the decisions are analysed in their scope.

The course not only promotes an understanding of the substantive development of European law, but also teaches key practical professional skills such as rhetorical confidence, strategic legal thinking and the ability to precisely analyse complex issues.
